Hi ppl

My boat has a bit of damage on it and its under warrenty. The company said they would get me a new boat. Do they have to give me a new kayak or is there a chance they could give me a 2nd hand kayak? I have only had the kayak for about 4 months.

If you damaged a new boat they must give you a new boat. if you f**ked up you boat for 20 months and finally damaged it they should also give you a new boat but might give you an used boat. Depends on the fairness of the manufacturer.

Its not a problem about the damage on the boat as the company has said it wasnt my fault. And said its under warrenty. Its only about 4 months old, do u think there a chance they could give me a used boat or do they have to give me a new boat, as it wasnt my fault.

If they said \"it was under waranty, and they also said they will replace it\" it will be a brand new kayak. I fit is out of warrenty and is down to pilot error then its just unlucky. I have had two boats replaced under warrenty from different manufacturers. Both gave me a brand new replacement. Adrian had a few problems with one of his boats and ageain a different manufacturer replaced it under warrenty on several occasions.

If however you broke your boat just due to bad luck and was pilot error the company have every right to say no! It the same with cars if you go out and buy a £20,000 drive away and wrap around a tree its not a warrenty claim!

You should really be asking the kayak manufacturer these questions becausee they are the ones who can answer them. Here, you will only get speculation and what others have gone through (which could be a different situation that yours)

I have worked for a few manufacturers. Some will giveyou a prime quality, brand new boat. Some will giveyou just a hull. Some will give you a \"second\" quality boat with minor cosmetic flaws that they usually give to their pros (but not to a retail store). But, all of them treat each case as an individual case and make decisions based on their own internal policies. So, best to ask the kayak maker directly.

I work at a paddling shop in BC and based on my experience at worst they would give you a factory second. this means that there is a cosmetic problem. If you paid for a new boat I would argue for a new boat, if they try to give you a used one. A factory second, slight mis-colour in a small spot or small visible weld mark in a non-structural place, is another thing. I deal mainly with Dagger and Wavesport.
